By placing an order for custom surfboards or any other services offered by HC Surfboards, you acknowledge that you have read, understood, and agreed to these terms and conditions.
1. Manufacturing Services
1.1 HC Surfboards will provide manufacturing services for custom surfboards as requested by the customer.
1.2 The manufacturing process will begin upon receipt of the customer's order and payment (non-refundable) of the deposit, unless otherwise agreed upon in writing.
1.3 HC Surfboards reserves the right to refuse any order that it deems inappropriate, illegal, or in violation of any intellectual property rights.
1.4 The manufacturing timeline provided by HC Surfboards is an estimate and may be subject to change due to unforeseen circumstances or delays beyond our control. HC Surfboards will make reasonable efforts to keep the customer informed of any significant delays.
2. Pricing and Payments
2.1 The prices for manufacturing services are stated in New Zealand dollars and are exclusive of any applicable taxes, shipping costs, duties, or customs fees.
2.2 The customer agrees to pay the total amount specified at the time of order placement, including any additional charges for customisation and shipping.
2.3 Payments can be made via authorised credit/debit cards, bank transfers, or other payment methods accepted by HC Surfboards. Credit card payments will incur an additional 3% fee.
2.4 HC Surfboards reserves the right to change the pricing of its manufacturing services at any time. However, such changes will not affect orders that have already been placed and fully paid for.
3. Ownership and Intellectual Property
3.1 The customer acknowledges that HC Surfboards retains all rights, title, and interest in any proprietary information, designs, trademarks, or other intellectual property used during the manufacturing process.
3.2 The customer certifies that any designs, artwork, logos, or other materials provided by them for customisation are free from any third-party intellectual property rights infringement. The customer shall indemnify and hold HC Surfboards harmless against any claims, damages, or expenses arising from the use of such materials.
4. Liability and Warranty
4.1 Surfboards aren’t covered under warranty due to the nature of the product and the unpredictable environment they’re used in but are covered for manufacturing errors. For any issues with your surfboard please contact our team and we’ll be able to determine if the damage or defect is due to manufacturing or if it’s caused by user damage.
4.2 The manufacturing warranty does not cover damage caused by improper handling, storage, transportation, accidents, normal wear and tear, or any modifications made by the customer or third parties.
4.3 In case of defects covered under warranty, the customer must notify HC Surfboards in writing and provide supporting evidence. HC Surfboards will review and assess the claim at its sole discretion and may repair, replace, or refund the defective product.
4.4 HC Surfboards shall not be held liable for any indirect, incidental, special, or consequential damages arising from the customer's use or misuse of the manufactured surfboards, regardless of whether HC Surfboards has been informed of the possibility of such damages.
5. Governing Law and Jurisdiction
5.1 These manufacturing terms and conditions shall be governed by and construed in accordance with the laws of New Zealand.
5.2 Any disputes or claims arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts located in New Zealand.
By placing an order with HC Surfboards, the customer agrees to adhere to these terms and conditions. HC Surfboards reserves the right to update or modify these terms and conditions at any time without prior notice. It is the customer's responsibility to review the latest version available on our website before placing an order.
